ARTICLES OF

AGREEMENT

under Seal made this Second day of September 1932 BETWEEN HIS EXCELLENCY Mr. WILFRID THOMAS SOUTHORN C.M.G., Officer Administering the Government of the Colony of Hong Kong and its Dependencies (who and whose successors in office are hereinafter referred to as "the Governor") for and on behalf of the Government of the said Colony of the one part and THE EASTERN EXTENSION AUSTRALASIA and CHINA TELEGRAPH COMPANY LIMITED (hereinafter called "the Company") for and on behalf of themselves and The Great Northern Telegraph Company Limited of Copenhagen Denmark of the second part and THE HONG KONG TELEPHONE COMPANY LIMITED whose registered office is at Victoria in the said Colony (hereinafter called "the Telephone Company") of the third part SUPPLEMENTARY to Articles of Agreement made between the parties hereto of the first and second parts on the 19th day of April, 1932, hereinafter called "the principal agreement" WHEREAS the Telephone Company has requested the Company to allow the Telephone Company to attach brackets and wires to certain telegraph poles belonging to the Company and erected or maintained by the Company on Crown Land adjacent to the Kowloon Canton Railway under or by virtue of the principal agreement, namely Forty three poles between Taipo Market Station and the Hong Lok Yuen Gardens at Gills cutting and Twelve poles between Taipo (immediately below the residence of Mrs. Clarke) and No. 5 Tunnel and from time to time as occasion may hereafter arise to attach brackets and wires to other poles belonging to the Company and attach wires to brackets (in tunnels and elsewhere) belonging to the Company at other points where such poles and brackets may be maintained upon Crown Land under or by virtue of the principal agreement which request the Company is desirous of granting.

AND WHEREAS the Company has requested the Governor to permit such use by the Telephone Company as aforesaid which the Governor has agreed to do on the terms and conditions hereinafter contained.

NOW IT IS HEREBY MUTUALLY AGREED as follows :-

THE Governor grants and the Company ratifies and confirms unto the Telephone Company permission to attach brackets and wires to the poles hereinbefore particularly specified and to attach brackets and wires to other poles and attach wires to other brackets as herein- before mentioned and to maintain the same during the period for which the principal agreement shall remain in force.

THE number of wires which may be attached to any bracket or pole may be eight (including the wires of both the Company and the Telephone Company) but shall not exceed that number without the written consent of the Governor.

IF in the opinion of the Governor it shall be found that the number of wires on any bracket or pole constitutes a danger to traffic on the railway the Governor may by notice require the Company either so to strengthen such pole or bracket as in the opinion of the Governor to remove all danger or, at the discretion of the Governor, forthwith to reduce the number of wires to any number of not less than three and in default of compliance with any such notice the Governor may cause to be removed all wires exceeding that number.
